MACSFILM PHOTOGRAP​HY & VIDEO TERMS & CONDITIONS

  • CLIENT SATISFACTION: Client agrees to cooperate fully and understand that without full cooperation and communication by client, satisfaction cannot be guaranteed. Photographer / Cinematographer is not responsible if Client and/or key individuals fail to appear or cooperate during the wedding/event coverage, portrait sessions, video shoot, or for missed images/video clips due to details not revealed to Photographer / Cinematographer. If Client and/or key individuals fail to appear to a scheduled event, portrait session, the deposit is non-refundable. The session can be rescheduled at the original portrait session fee, including an additional deposit.
     

  • RAW IMAGES: I understand that no unedited images (".RAW") are given with any packages. Photographer will select and fully edit the maximum amount of high quality images for you to choose from. The client understands that he/she has chosen the photographer because of her photographic style, and will grant the photographer the right to exercise his/her creativity in the interest of creating the best images possible. The client understands he/she may not demand a refund, or a redo due to differences in artistic preferences of the final images.
     

  • REFUNDS: We are proud of our dependable performance record. In the unlikely event we are unable to perform our services, we will refund your down payment/retainer.
     

  • WEDDING DOWNPAYMENT/RETAINER: An initial non-refundable retainer of 50% of the total cost is required with this signed agreement to hold shooting dates and Photography planning. Upon signature, the photographer/cinematographer reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the retainer is non-refundable, if the event is canceled for any reason, including, but not limited to acts of God, fire, extreme weather, break-up, and/or financial hardship. The retainer is to be paid at the time of parties signing this agreement. If for any reason, the client changes event date, the retainer can be transferred to a new event date if the photographer/cinematographer has the date available; otherwise, there is no refund for retainer paid.
     

  • CANCELLATION/POSTPONEMENT: Client understands that by entering into this agreement, Photographer /Cinematographer is foregoing other photographic/video jobs. In the event of a cancellation or postponement of the portrait/video session/agreement by Client, the deposits paid are non-refundable. Deposits are transferable if a date change is necessary. Forty-eight hours notice of postponements or cancellations is appreciated.
     

  • WEATHER: If it is not possible for an event or session to take place on a scheduled day due to weather, Photographer / Cinematographer and Client will reschedule on an agreed date at the earliest date possible, with no additional charge.
     

  • PROMOTIONAL USE: Macsfilm llc / Michelangelo’s Photography reserves the right to use the footage/material/ media, either in sections or in its entirety, for promotional purposes of our production house and /or services.
     

  • FULL RIGHTS TO PRINT: This release gives clients the rights to reproduce and print high-resolution images for personal use. You may not edit, alter or change these photos in anyways.
     

  • CLIENT’S USAGE: Client is obtaining prints for personal use only, and shall not sell said prints or authorize any reproductions by parties other than Photographer. Prints for publication (such as editorial, public relations or advertising use) require prior written consent from Photographer. A credit line which reads “Macsfilm llc / Michelangelo's Photography” in type no smaller than that of the related text must appear adjacent to or within all permitted published photographs.
     

  • EXHIBITION: Client grants Photographer permission to display selected images / video clips resulting from this assignment as an example of Photographer’s / Cinematographer's work and for entrance into photographic / video competitions and releases all claims to profits that may arise from use of images or video.
     

  • MODEL RELEASE: Client grants to Photographer/Cinematographer  and her legal representatives and assigns, the irrevocable and unrestricted right to use and publish photographs/video of Client, Client’s child or children, or in which Client may be included for editorial, trade, advertising and other purposes, and in any other manner and medium; to alter the same without restriction; and to copyright the same. Client hereby releases Photographer/Cinematographer and her legal representatives and assigns from all claims and liability relating to said photographs.
     

  • ASSIGN/SUBSTITUTIONS: In the event of illness or any reason outside the control of the production we reserve the right to substitute any of our crew members(s) assigned.
     

  • PERMISSION: If applicable, it is your responsibility to get permission of locations or other officials. We will abide by the rules of the location regarding camera placement...
     

  • PORTRAITS DOWNPAYMENT: (Engagement or Bridal Sessions Only) An initial non-refundable retainer $100 of the total cost is required with this signed agreement to hold shooting dates and Photography planning. Upon signature, the photographer/cinematographer reserves the time and date agreed upon, and will not make other reservations for that time and date. For this reason, the retainer is non-refundable, if event is cancelled for any reason, including, but not limited to acts of God, fire, extreme weather, break-up, and/or financial hardship. Retainer is to be paid at time of parties signing this agreement. If, for any reason, client changes event date, the retainer can be transferred to new event date if photographer/cinematographer has the date available; otherwise there is no refund for retainer paid.
     

  • TRAVELING EXPENSES: 30 miles are free and after that $.50 per mile from my zip code 76247.
     

  • MEALS: Weddings only, we ask that a courtesy meal be provided to our photographers/videographer and assistants if the event is longer than 5hrs.
     

  • OVERTIME: If the production lasts longer than agreed upon time. Possibly, the hourly ( $100 ) will be added to your production cost.
     

  • BALANCE DUE: Remaining balance is due at the beginning of photoshoot/video shoot.
     

  • GOOD COVERAGE: Client acknowledges that reasonable light, camera view, and control access is required for good coverage.
     

  • POST PRODUCTION: Post -Production editing usually takes 2-4 weeks to complete.
     

  • DVD/BLU-RAY COMPATIBILITY: If applicable, we produce DVD/BLU-RAY’s using the most compatible media for DVD/BLU-RAY players. Our DVDs are Region 1, unless otherwise stated in our catalog. We are not responsible if your DVD/BLU-RAY player is not zone-compatible. Some DVD/BLU-RAY players, especially older models, have compatibility issues with some DVDs/BLU-RAY. We are not responsible for any DVD/BLU-RAY that is incompatible with your player.
     

  • LIABILITY INSURANCE: If your venue requires a certificate of liability insurance, please forward your venue’s contact information and requirements to us.
